Persbericht asielcrisis
Bij de publicatie van het regeringsplan vandaag is een zogenaamde asielcrisis uitgeroepen. Het woord “crisis” wordt gebruikt zodat de regering zich kan beroepen op een uitzonderingssituatie, die het mogelijk zou maken om de Nederlandse Vreemdelingenwet grotendeels buiten werking te stellen. De bedoeling hiervan is om asielaanvragen en aanvragen voor gezinshereniging niet meer te hoeven behandelen, en dus om vluchtelingen en hun gezinnen volledig aan hun lot over te laten, in strijd met een groot aantal internationale verplichtingen waar Nederland aan is gebonden. De meest kwetsbare groep in onze samenleving wordt geslachtofferd en de reputatie van Nederland als democratische rechtsstaat wordt te grabbel gegooid.
De regering beroept zich dus op noodrecht. In een rechtsstaat wordt daar enkel een beroep op gedaan als er oorlog uitbreekt, of bij grootschalige natuurrampen en pandemieën. Dictaturen daarentegen plegen zich ook op noodrecht te beroepen in andere situaties. Het is dan ook ronduit schokkend dat de Nederlandse regering overgaat tot het uitroepen van een noodsituatie zonder dat de feiten daar aanleiding toe geven. Er is niets uitzonderlijks aan de huidige asielinstroom in Nederland. Het enige uitzonderlijke is dat extreem rechts aan de macht is in Nederland.
Wat de exacte uitwerking zal zijn van deze aankondiging van de regering zal spoedig moeten blijken. Veel is momenteel nog onduidelijk. Een ding is wel zeker, en dat is dat wij ons zullen blijven inzetten om de best mogelijke rechtsbijstand te leveren aan asielzoekers, vluchtelingen en alle andere migranten in Nederland – juist nu. Press release asylum crisis
With the publication of the government plan today a so-called asylum crisis was announced. The word “crisis” is being used so that the government can rely on a situation of exception, which would make it possible to disable the Dutch Alien Act for the biggest part. The government does that in order not to have to process asylum requests and request for family reunifications anymore, and therefore to completely abandon refugees and their family members, violating numerous international obligations that the Netherlands is bound too. The most vulnerable group in our society is being vitcimised and the reputation of the Netherlands as a democratic state that upholds the rule of law is thrown up for grabs.
The government is invoking emergency law. In a democratic constitutional state this is only being done when war breaks out, or in case of large natural disasters or pandemics. Dictatorships however also invoke emergency law in other circumstances. It is downright shocking therefore that the Dutch government announces a state of emergency without the facts to support it. There is nothing exceptional about the number of asylum seekers coming to the Netherlands currently. The only thing that is exceptional is that the extreme right is in power in the Netherlands.
What will be the exact implications of this government announcement will soon have to become clear. A lot is still uncertain as of yet. One thing is for certain though, which is that we will continue to commit all or our work and efforts to offer the best possible legal aid to asylum seekers, refugees and all other immigrants in the Netherlands – especially now.
